Terms of Service

1. What is HoldTrakr?

HoldTrakr is an information platform where investors (creators) publish their verified broker data and other users (followers) can gain insight into their investment history. The platform offers information services only — no investment advice, asset management, or order execution.

HoldTrakr is always the service provider — not the individual creator. Payments always go through the platform.

2. Creator terms of use

As a creator on HoldTrakr you agree to the following:

• You upload only real, unmanipulated broker data of your own.
• You grant HoldTrakr permission to calculate and publish your returns and statistics.
• You do not post information that qualifies as investment advice, recommendation, or tip.
• You accept that trades are published with a mandatory 24-hour delay (MAR compliance).
• You receive 80% of subscription revenue; HoldTrakr retains a 20% commission.
• Creator Pro costs €9.99/month and can be cancelled at any time.
• HoldTrakr may remove your profile in case of fraud, misrepresentation, or violation of these terms.

3. Follower terms of use

• You use information on HoldTrakr solely for informational purposes, not as investment advice.
• You do not share content from paid subscriptions with non-subscribers.
• You are at least 18 years old.
• You are responsible for all investment decisions you make — HoldTrakr is never liable for these.

4. Payments and refunds

Subscriptions renew automatically monthly. Prices range from €3.00 to €30.00 per month per creator.

Cancellation is always possible. After cancellation you retain access until the end of the paid period.

Refunds are provided only for technical failures on our part that demonstrably prevented service delivery, or as required by applicable consumer law. Requests by email: support@holdtrakr.com.

5. Prohibited use

It is prohibited to use HoldTrakr for:

• Uploading falsified, edited, or misleading broker data
• Providing investment advice or recommendations
• Automated scraping or bulk download of platform data
• Creating multiple accounts to circumvent verification limits
• Participating in, or facilitating, market manipulation or front-running
• Any use contrary to applicable laws and regulations

6. Limitation of liability

HoldTrakr's total liability to you is at all times limited to the amount you paid to HoldTrakr in the three months prior to the damage-causing event. HoldTrakr is never liable for indirect damage, investment losses, or consequential damage.

7. Intellectual property

All rights to the platform, software, design, and brand identity of HoldTrakr belong to HoldTrakr B.V. (in formation). Reproduction without written permission is not permitted.

Creators retain intellectual property rights to analyses and comments they post. By publishing, they grant HoldTrakr a non-exclusive licence to display this content to subscribers.

8. Account termination

You can delete your account at any time via Settings → Delete account. Your data will be permanently deleted within 30 days, except for data we are required to retain by law.

HoldTrakr reserves the right to terminate your account for violation of these terms, in particular for proven fraud or misrepresentation.

9. Governing law

These terms and the use of HoldTrakr are governed by Dutch law. Disputes shall be submitted to the competent court in the district of Amsterdam, unless mandatory consumer law designates a different court.
